South Dakota Laws and Requirements for Homeschool

In South Dakota, homeschooling is recognized as "alternative instruction" under state law.

Notification Requirements

  • Alternative Instruction Notification: Within 30 days of beginning homeschooling, parents or guardians must submit an Alternative Instruction Notification form to the South Dakota Department of Education. This form can be completed online or downloaded for submission.

  • Updates: If there is a change in the child's status—such as moving to a different school district or discontinuing homeschooling—an updated notification must be submitted within 30 days of the change.

Instructional Requirements

  • Compulsory Attendance: Children must receive instruction until they reach 18 years of age.

  • Instructor Limitations: An individual providing alternative instruction may not instruct more than 22 students.

  • Instructor Qualifications: There is no requirement for the instructor to hold state certification.

Curriculum and Assessment

  • Subjects: Parents are required to teach the basic skills of language arts and mathematics.

  • Assessments: South Dakota does not mandate standardized testing for homeschooled students. However, parents may choose to administer such tests to monitor progress.

Recordkeeping

While the state does not specify recordkeeping requirements, it is advisable for parents to maintain thorough records of their homeschooling program. This can include attendance logs, curriculum details, samples of the student's work, and any assessment results. These records can be valuable for future educational transitions or if questions arise regarding the child's education.

Participation in Interscholastic Activities

Homeschooled students in South Dakota are permitted to participate in athletics, fine arts, and other interscholastic activities within their resident school district. To be eligible, students must meet the same requirements as publicly enrolled students, which may include providing proof of age and academic progress.
